The MACC Model Clauses
Institutional Arbitration Clause
Recommended for all types of commercial contracts.
"Any dispute, controversy or claim arising out of or relating to this contract, or the breach, termination or invalidity thereof, shall be settled by arbitration in accordance with the Arbitration Rules of the Madurai Arbitration and Conciliation Council (MACC). The seat of arbitration shall be Madurai. The language of the arbitration shall be English/Tamil. The number of arbitrators shall be [one/three]."
Mediation & Conciliation Clause
Recommended for multi-tier dispute resolution.
"In the event of any dispute arising out of or in connection with this contract, the parties shall first endeavor to settle the dispute amicably by mediation in accordance with the Mediation Rules of the Madurai Arbitration and Conciliation Council (MACC). If the dispute is not settled by mediation within [30/60] days of the appointment of the mediator, the dispute shall be settled by arbitration as per MACC Rules."
Online Dispute Resolution (ODR) Clause
Recommended for technology and distance-based contracts.
"The parties agree that any dispute arising out of this agreement shall be resolved through Online Dispute Resolution (ODR) in accordance with the ODR Rules of the Madurai Arbitration and Conciliation Council (MACC). The proceedings shall be conducted exclusively through the MACC ODR Portal."
